Judge Brian E. Murphy: ELECTRONIC ORDER entered DENYING 1 petition for writ of habeas and 2 emergency motion for temporary restraining order (“TRO”).Petitioner seeks a stay of his removal and declaratory relief stating that he is a member of the class protected from removal in Immigration Center for Women and Children v. Noem (ICWC), 351 F.R.D. 324 (C.D. Cal. 2026). Dkt. 1 at 11. However, this Court lacks jurisdiction to hear claims related to the government's decision to "commence proceedings, adjudicate cases, or execute removal orders against any alien." 8 U.S.C. s. 1252(g) (emphasis added). Furthermore, Petitioner is, by his own admission, not a member of the ICWC class because he has not yet filed his T-visa application. Dkt. 1 at 7 ("Petitioner will become a class member... upon the filing of his Form I-914."); id. at 2 ("Petitioner respectfully requests an immediate temporary restraining order staying his removal for a period sufficient to allow counsel to file his T-visa application."). Therefore, Petitioner is not entitled to relief under ICWC.Accordingly, the petition is DENIED and Petitioner's motion for a TRO is DENIED AS MOOT. (MBM) (Entered: 08/31/2026)
