Judge Brian E. Murphy: ELECTRONIC ORDER entered GRANTING the petition. The Court ordered Respondents to “determine whether Petitioner is a member of the class certified in Guerrero Orellana v. Moniz, No. 25-CV-12664-PBS (D. Mass.), and notify the Court no later than 1:00 p.m. on Monday, August 31, 2026,” and, along with that response, provide “copies of any Notices to Appear, Warrants for Arrest of Alien, or Notices of Custody Determination issued in connection with Petitioner’s current detention.” Dkt. 4 at 2. The Court stated that “[i]f Respondents fail to respond as directed by either of the above deadlines, the Court will assume that Petitioner’s detention is unlawful and order that Petitioner be immediately released.” Id. Respondents failed to timely respond to the petition or to provide copies of any documents that support lawful detention of Petitioner. Because the Court has no basis to conclude that Petitioner’s detention is lawful, the petition is GRANTED and Petitioner is ORDERED immediately released. In addition, the Court reminds the U.S. Attorney’s Office of its obligation to file a Notice of Appearance at the first opportunity, to ensure that Court deadlines are met and orders complied with in a timely manner. That no one has of yet filed a Notice of Appearance in a case first filed on Friday, August 28, 2026, is inappropriate in light of the stakes and time-sensitive nature of such cases. Respondents are further ORDERED to file a status report on or before 12:00 p.m. on Tuesday, September 1, 2026, detailing their compliance with this order. (MBM) (Entered: 08/31/2026)
