Judge Brian E. Murphy: ELECTRONIC ORDER entered. Petitioner filed a petition for a writ of habeas corpus in this Court on August 27, 2026. Dkt. 1 . At 1:53 p.m. on the date filing, this Court ordered that “respondents will not remove the petitioner from the jurisdiction of the United States or transfer petitioner to a judicial district outside that of Massachusetts for a period of at least 72 hours from the time this Order is docketed.” Dkt. 4 at 4. The Court further ordered “If Respondents contest that Petitioner is presently confined in the District of Massachusetts, Respondents shall file a notice in writing on the docket stating the name and location of the facility in which Petitioner is confined. Such notice shall be provided promptly after Respondents become aware of that fact.” Id. Petitioner’s counsel has notified the Court that Petitioner was transferred from Massachusetts to Colorado on August 27, 2026. Dkt. 6 ; see also Dkt. 6 -3. Because Petitioner’s counsel does not know the exact time Petitioner was transferred, and because Respondents did not notify the Court that Petitioner had been transferred, the Court cannot determine whether Respondents complied with this Court’s August 27 Order. Accordingly, Respondents are ORDERED, on or before 10:00 a.m. on Monday, August 31, 2026, to submit an affidavit explaining the time at which Petitioner was transferred out of the Commonwealth on August 27, 2026. Respondents are further to inform Petitioner’s counsel where his client is being detained by 6:00 p.m. today. Judge Brian E. Murphy: ELECTRONIC ORDER entered GRANTING 1 the petition for a writ of habeas corpus. Given Respondents’ failure to comply with the dates set forth in this Court’s order, Dkt. 7, Respondents are ORDERED to fly Petitioner back to the District of Massachusetts at no cost to him and to release him from custody on or before 5:00 p.m. on September 1, 2026. In addition, the Court reminds the U.S. Attorney’s Office of its obligation to file a Notice of Appearance at the first opportunity, to ensure that Court deadlines are met and orders complied with in a timely manner. That Respondents did not file a Notice of Appearance in a case first filed on Thursday, August 27, 2026, until nearly 11:30 a.m. on August 31, 2026, is inappropriate in light of the stakes and time-sensitive nature of such cases.
