Text Only Entry (In Chambers) Order by Judge Stanley Blumenfeld, Jr.: Petitioner filed a petition for a writ of habeas corpus and two applications for a temporary restraining order (TRO). General Order 26-05 establishes an expedited briefing schedule for immigration habeas petitions in recognition of the inherent exigency of immigration detention. GO 26-05. A petitioner seeking relief on an even more expedited basis must therefore demonstrate imminent, irreparable harm that cannot be addressed by the General Orders schedule. Id. If the government does not oppose the relief sought in the TRO application or petition, it shall promptly notify the Court. Otherwise, the government shall file a response by September 3, 2026 and Petitioner shall file any reply no later than September 17, 2026. In its response, the government shall address the statutory basis for his detention, including whether Petitioner is entitled to an initial bond hearing pursuant to Rodriguez Vazquez v. Bostock, No 25-6842, 2026 WL 2196424 (9th Cir. 2026) and whether Petitioner is subject to a final order of removal, and shall attach relevant documents concerning Petitioner's detention. Failure to substantively address the arguments in the petition may be construed as consent to granting the requested relief. To facilitate prompt resolution of the petition, Petitioner should file any reply earlier if practicable.
