JUDGMENT pursuant to Rule 58 entered in favor of petitioner and against respondents as follows: respondents shall (1) release petitioner forthwith; (2) in the event respondents rearrest petitioner at the time of his release, upon request by petitioner they shall cause petitioner to be taken before a neutral immigration judge of the Executive Office of Immigration Review for an individualized bond hearing within the customary time for scheduling such a hearing; and (3) in the event a bond hearing is held, respondents shall ensure the hearing includes the required attributes of due process, including interpretation services if necessary; further finding that the government's position was substantially justified and declining to award fees; denying the petition in all other aspects; and directing the Clerk of Court to mark the case closed.
