Order on Petition for Writ of Habeas Corpus

TEXT ORDER. Before the Court is Jose Manuel Vasquez Urena's Petition for a writ of habeas corpus under 28 U.S.C. § 2241. Upon review, the Court finds that this matter is controlled by Guerrero Orellana v. Moniz, Nos. 25-2152, 26-1094, 2026 WL 2352042 (1st Cir. Aug. 13, 2026). That the Petitioner's parole under 8 U.S.C. § 1182(d)(5)(A) has lapsed does not alter the result. Upon a return to custody a parolee is "dealt with in the same manner as that of any other applicant for admission," 8 U.S.C. § 1182(d)(5)(A), and such persons are detained under 8 U.S.C. § 1226(a). Accordingly, the Court GRANTS the Petitioner's habeas Petition (ECF No. 1 ) as follows. The Respondents are ORDERED to provide the Petitioner with a bond hearing before an Immigration Judge pursuant to 8 U.S.C. § 1226(a) no sooner than thirty (30) days from the date of this order. The Respondents are ordered to provide the Petitioner and his attorney with adequate notice of the date and time of that hearing. Further, the Court ORDERS the Respondents to release the Petitioner immediately pending the bond hearing. The Court permits the Petitioner's transfer to effectuate his release and the return of his property. The Respondents shall set minimal release conditions that will reasonably assure the Petitioner's appearance at the bond hearing. Finally, the Court ORDERS the Respondents to file a status report within two (2) days of the Petitioner's bond hearing, stating whether he has been granted bond and, if his request for bond was denied, the specific reasons for that denial.
