ORDER denying 2 Motion for Preliminary Injunction. In his 2 Motion for Preliminary Injunction, Petitioner requests that the Court "enter a preliminary injunction: (i) ordering Respondents to provide Petitioner with an individualized bond hearing before an immigration judge within seven (7) days of the Court's order, at which Respondents shall bear the burden of proving by clear and convincing evidence that Petitioner's continued detention is justified, and at which Respondents shall be barred from contesting the immigration judge's jurisdiction on the basis of 8 U.S.C. § 1225(b), Matter of Q. Li, or Matter of Yajure Hurtado; (ii) ordering that Petitioner be released immediately if no such hearing occurs within seven (7) days; and (iii) granting such other and further relief as the Court deems just and proper." Doc. 2 at 2-3. This request by Petitioner seeks the same substantive relief sought by his 1 Petition for Writ of Habeas Corpus, see Doc. 1 at 20, and is a request for affirmative relief, rather than the maintenance of the status quo. A preliminary injunction is not an appropriate avenue for this type of relief. Having so found, the Court understands Petitioner's 1 habeas petition to ultimately be seeking a prompt review of the lawfulness of Petitioner's detention, and relief, in the form of, at a minimum, an individualized bond hearing.
