TEXT ORDER: The Court having reviewed Respondents' August 28, 2026 letter concerning Petitioner's criminal history (ECF No. 4), it appears that Respondents have identified only a 2024 conviction for violating Township of Irvington Code § 355-15A(1), concerning the requirement for a certificate of housing compliance. That municipal ordinance violation is not, on the record presently before the Court, a conviction for a crime or a disorderly persons offense. See N.J.S.A. 2C:52-4 (separately addressing municipal ordinance violations); N.J.S.A. 2C:52-6 (separately identifying municipal ordinance violations). Respondents have identified no other criminal conviction. Accordingly, the Court finds that Respondents have not identified a criminal history of the type contemplated by the Court's August 25, 2026 Text Order (ECF No. 2). Respondents further have not identified in their August 28 submission any final order of removal or other basis that would preclude Petitioner's release. Consistent with the Court's August 25, 2026 Text Order (ECF No. 2), Respondents shall therefore RELEASE Petitioner from immigration detention no later than 24 hours from entry of this Order, unless Respondents identify a lawful basis for continued detention supported by the applicable statutory authority.
