Judge Allison D. Burroughs: ELECTRONIC ORDER entered. Currently before the Court is Petitioner’s emergency motion for an order to show cause why the Court’s August 24, 2026, order should not be enforced and Petitioner returned to this district. [ECF No. 7 ]. On August 24, 2026, Petitioner filed his petition for writ of habeas corpus. [ECF No. 1 ]. On that same day, the Court entered an order stating, “unless otherwise ordered by the assigned judge, respondents will not remove the petitioner from the jurisdiction of the United States or transfer petitioner to a judicial district outside that of Massachusetts for a period of at least 72 hours from the time this Order is docketed.” [ECF No. 2 ]. On August 25, 2026, the assigned judge entered an order again stating that Petitioner shall not be transferred out of this district unless the Respondents provides advance notice. [ECF No. 4 ]. Later on August 25, 2026, the government filed a notice stating that “on August 25, 2026 (before the habeas petition was filed), Petitioner was transferred to the Strafford County Department of Corrections in Dover, New Hampshire, where he is currently confined.” [ECF No. 6 at 1]. Respondents’ notice, however, also correctly states that Petitioner filed his petition on August 24, 2026. [Id.]. Petitioner has also indicated that he was moved again on August 26, 2026, to the Central Louisiana ICE Processing Center in Jena, Louisiana, in further contravention of the Court’s order. [ECF No. 7 ]. Respondents are hereby ORDERED to file a status report by 5:00PM today, August 28, 2026, clarifying the following information: (1) the date and time at which Petitioner was transferred to the Strafford County Department of Corrections in Dover, New Hampshire; (2) whether Petitioner has been moved to the Central Louisiana ICE Processing Center and, if so, the date and time at which Petitioner was transferred to Louisiana; and (3) why the Court’s August 24, 2026, stay of transfer or removal, [ECF No. 2 ], should not be enforced.
