To ensure that all cases heard in the Southern District of New York are handled promptly and efficiently, all parties must keep the court apprised of any new contact information. It is a party's obligation to provide an address for service; service of court orders cannot be accomplished if a party does not update the court when a change of address occurs. Accordingly, all self-represented litigants are hereby ORDERED to inform the court of each change in their address or electronic contact information. Parties may consent to electronic service to receive notifications of court filings by email, rather than relying on regular mail delivery. Parties may also ask the court for permission to file documents electronically. Forms, including instructions for consenting to electronic service and requesting permission to file documents electronically, may be found by clicking on the hyperlinks in this order, or by accessing the forms on the courts website, nysd.uscourts.gov/forms. The procedures that follow apply only to cases filed by pro se plaintiffs. ORDER TO SHOW CAUSE: I am in receipt of Petitioners petition for a writ of habeas corpus under 28 U.S.C. § 2241, which was filed on August 24, 2026 at 4:03 p.m. ET. (Doc. 1 (Habeas Petition).) Petitioners next friend states that Petitioner is currently being held at 26 Federal Plaza. (Id. at 4.) Upon consideration of Petitioners Habeas Petition, it is hereby ORDERED that:1. To preserve the Courts jurisdiction pending a ruling on the petition, Petitioner shall not be removed from the United States unless and until the Court orders otherwise.0F12. Petitioner shall not be transferred except to a facility within this District, the Eastern District of New York, or the District of New Jersey absent further order of this court in light of Petitioners interest in participating in further proceedings before this Court and maintaining adequate access to legal counsel through these proceedings. 3. Respondents shall show cause, pursuant to 28 U.S.C. § 2243, why the Petition for Writ of Habeas Corpus should not be granted by August 31, 2026.4. Petitioner shall have the opportunity to file a reply by September 8, 2026.5. This matter shall be heard by the Court on September 11, 2026 at 2:00 p.m. ET. The dial-in number is 1-855-244-8681 and the access code is 2309 3085 835. There is no attendee ID.6. The parties shall also attend an initial telephonic case conference on Wednesday, August 26, 2026 at 11:00 a.m. ET. The dial-in number and access code are the same as for the Order to Show Cause Hearing. The parties should be prepared to address venue, under what statutory provision petitioner is being detained, and provide additional details about petitioners detention, such as any accompanying documents.7. ORDER: In other words, the government must show by clear and convincing evidence that "the noncitizen presents a flight risk or a danger to the community." M.P.L. v. Arteta, No. 25-CV-5307, 2025 WL 2938993, at *5 (S.D.N.Y. Oct. 16, 2025) (quoting Black v. Decker, 103 F.4th 133, 15354 (2d Cir. 2024)). Further "the immigration judge must consider alternatives to detention and Petitioner's financial ability to pay a bond in making the bond determination." Id. at *1.
