Stearns: ELECTRONIC ORDER entered re 10 Response to Petition for Writ of Habeas Corpus - 2241, filed by U.S. Department of Homeland Security, Markwayne Mullin, David Wesling, David Venturella, Todd Blanche, Antone Moniz. Petitioner David Domingos Freire Junior is a native and citizen of Brazil who lawfully entered the United States on a visa in 2021. While the government attaches an article to its Response accusing him of participation in an immigration scheme, he has no criminal record and no qualifying criminal conviction or release from criminal custody. The government agrees that Domingos Freire Junior is entitled to a bond hearing. The court directs the government to arrange a bond hearing for David Domingos Freire Junior before an Immigration Judge (consistent with the standards outlined in Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021)), as soon as practicable, but in no case later than Tuesday, September 8, 2026.
