TEXT ORDER - The Court has reviewed the Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner Angel Arellano Garrido ("Petitioner"), who is currently detained at Elizabeth Detention Facility in Elizabeth, New Jersey. (ECF No. 1.) According to the Petition, Petitioner is a native of Mexico who entered the United States in or around 2001, without inspection. Petitioner alleges that he has resided in New Jersey for over twenty- five years. Petitioner also alleges that he has no open warrants or convictions that would warrant his arrest. The Court preliminarily concludes that Petitioner may be unlawfully detained under 8 U.S.C. § 1225 because Petitioner was apprehended inside the United States after residing here for an extended period, and therefore may instead be subject to detention under 8 U.S.C. § 1226. See Ayala Amaya v. Bondi, No. 25-cv-16428, 2025 WL 3033880 (D.N.J. Oct. 30, 2025). THEREFORE, unless Respondents contend that Petitioner (1) has a criminal history warranting detention; or (2) Petitioner is subject to a final order of removal; Respondents shall RELEASE Petitioner within 24 hours under the same conditions, if any, that existed prior to his detention, including, but not limited to, release: (1) within the State of New Jersey; (2) without the imposition of additional conditions (such as ankle monitors or electronic tracking devices); (3) with all clothing and outerwear worn at the time of detention, or other appropriate attire; and (4) with all personal property and documents that were seized at the time of detention. If Respondents contend that Ayala Amaya is distinguishable, they shall file a response to the Petition by August 26, 2026, setting forth the basis for that position. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall not be removed from the District of New Jersey during the pendency of these proceedings. So Ordered by Judge Karen M. Williams on August 23, 2026. TEXT ORDER - This matter comes before the Court upon a Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 ("Petition"). (ECF No. 1.) The Court has reviewed the Petition (ECF No. 1) and Respondent's Letter (ECF No. 5). The Court finds that Petitioner is detained pursuant to 8 U.S.C. § 1226(a), which requires an individualized bond hearing. Accordingly, the Petition is GRANTED IN PART. It is ORDERED that Respondents shall provide Petitioner with an individualized bond hearing pursuant to 8 U.S.C. § 1226(a) and 8 C.F.R. § 236.1(d) within seven (7) days of the date of this Order, and it is further ORDERED that within three (3) days of the bond hearing, Respondents shall file a letter advising the Court of the outcome upon which the Court will close this matter absent further relief being warranted. TEXT ORDER - The Court has reviewed Respondent's Letter (ECF No. 8) and Petitioner's Letter (ECF No. 9) concerning Petitioner's September 1, 2026 bond hearing. The Court ordered Respondents to provide Petitioner with an individualized bond hearing within seven days of the date of the August 27, 2026 Order. (ECF No. 7.) Petitioner alleges that the hearing was not fundamentally fair. (See ECF No. 9.) Because Ghanem v. Warden Essex Cnty. Correctional Facility, No. 21-1908, 2022 WL 574624, at *2 (3d Cir. Feb. 25, 2022), permits review of whether a bond hearing was fundamentally fair, Respondents shall, within seven (7) days, file the transcript or recording of the September 1, 2026 hearing. So Ordered by Judge Karen M. Williams on September 11, 2026. (Williams, Karen) (Entered: 09/11/2026)

TEXT ORDER This matter comes before the Court upon Petitioner's request for review of the September 1, 2026 bond hearing conducted before the Immigration Judge. (ECF No. 9.) The Court has reviewed the order of the Immigration Judge (ECF No. 8-1), the hearing transcript (ECF No. 11-1), and the parties' submissions (ECF Nos. 9, 11). In a fundamentally fair bond hearing, due process has three essential elements. A non-citizen "(1) is entitled to factfinding based on a record produced before the decisionmaker and disclosed to him or her; (2) must be allowed to make arguments on his or her own behalf; and (3) has the right to an individualized determination of his [or her] interests." Ghanem v. Warden Essex Cnty. Correctional Facility, No. 21-1908, 2022 WL 574624, at *2 (3d Cir. Feb. 25, 2022). Having conducted that review, the Court finds that the September 1, 2026 hearing satisfied the requirements of due process and fundamental fairness. Petitioner was represented by counsel, afforded the opportunity to present evidence and argument, and the Immigration Judge considered documentary submissions and articulated the basis for the determination on the record, including findings as to Petitioner's danger to the community grounded in the evidentiary record. The record reflects an individualized assessment of the relevant statutory factors and does not demonstrate any procedural deprivation that would undermine the reliability or integrity of the proceeding. Accordingly, the Court concludes that the bond hearing comported with the minimum requirements of fundamental fairness under Ghanem. In light of the relief previously granted, and no further relief being warranted, the Clerk of Court is directed to CLOSE this case. So Ordered by Judge Karen M. Williams on 9/18/26.
