(IN CHAMBERS) ORDER TO SHOW RE FAILURE TO ANSWER PETITION AND SHOW CAUSE WHY THE WRIT OF HABEAS CORPUS SHOULD NOT BE GRANTED by Magistrate Judge Daniel S. Roberts. To date, Respondents have not filed either of these required documents. Respondents ar e hereby ORDERED TO SHOW CAUSE in writing, no later than 9:00 a.m. on September 8, 2026, why they have failed to comply with the Court's order requiring them to file a Notice of Appearance and an Answer and show cause why the habeas petition sho uld not be granted. Respondents may do so by either filing the Notice of Appearance and an Answer in which they address ALL claims and bases alleged in the Petition or by filing a sworn Declaration showing good cause for their failure to comply wit h the Court's August 23rd Order and a commitment to a date by which they will file the required documents. FAILURE TO RESPOND TO THIS ORDER MAY BE TREATED AS A CONCESSION THAT PETITIONER IS ENTITLED TO THE RELIEF SOUGHT, OR AT LEAST THAT THE FAC TUAL ALLEGATIONS IN THE PETITION ARE TRUE. ORDER GRANTING PETITION FOR WRIT OF HABEAS CORPUS AND ORDERING IMMEDIATE RELEASE by Magistrate Judge Daniel S. Roberts: granting Petition for Writ of Habeas Corpus 1 . IT IS THEREFORE ORDERED that: 1. The Petition for Writ of Habeas Corpus is G RANTED. 2. Respondents shall immediately release Petitioner OMAR MOSQUEDA LARA (A-200-193-351) from custody, reinstate his parole under the same conditions that were in place before his re-detention on August 5, 2026, and return to him any personal property and documents seized from him at the time of his detention. 3. Respondents shall also provide Petitioner with a copy of this Order at or near the time of release. 4. Within two days of the date of this Order, Respondents shall file with the Court a status report confirming Petitioner's release and return of any personal property and documents.
