ORDER - IT IS ORDERED: The petitioner's motion to reopen (filing 12) is granted. The Clerk of the Court is directed to reopen this case. The respondents are enjoined from removing the petitioner from the United States and from the District of Nebraska until further order of the Court. If the petitioner has already been removed from Nebraska, the respondents are ordered to immediately return the petitioner to Nebraska. The Federal Public Defender for the District of Nebraska is appointed to represent the petitioner for the limited purpose of determining whether he is entitled to relief pursuant to 28 U.S.C. § 2241. In the event the Federal Public Defender should decline this appointment because of a conflict of interest or on the basis of the Amended Criminal Justice Act Plan, the Federal Public Defender shall provide the Court with a draft appointment order (CJA Form 20) bearing the name and other identifying information of the CJA Panel attorney identified in accordance with the Amended Criminal Justice Act Plan for this district. The Clerk of the Court shall provide a copy of this order to the Federal Public Defender for the District of Nebraska. The Clerk of the Court shall provide the petitioner with a copy of this order and a copy of Form CJA-23. The petitioner shall complete and return Form CJA-23 to the Court as promptly as possible. Counsel shall promptly confer and contact Judge DeLuca's chambers to discuss expedited case progression and scheduling an evidentiary hearing before Judge Gerrard. Ordered by Senior Judge John M.
