District Judge Angel Kelley: ELECTRONIC ORDER entered. Before the Court is Petitioner Rodrigo Miranda de Amorim’s Emergency Petition for Writ of Habeas Corpus. [Dkt. 1]. "Respondents' position is that Petitioner is eligible for a bond hearing under 8 U.S.C. § 1226," and Respondents "do not object to the Court ordering a bond hearing." [Dkt. 10]. Accordingly, Petitioner is subject to 8 U.S.C. § 1226’s discretionary detention framework and entitled to a bond hearing. He has not received such a hearing, so his detention is unlawful. Petitioner’s Petition [Dkt. 1] is GRANTED. Respondents are ORDERED to provide Petitioner with a bond hearing under 8 U.S.C. § 1226(a) within 10 calendar days of this Order, unless Petitioner requests an extension. Respondents are ENJOINED from denying Petitioner bond on the basis that he is detained pursuant to 8 U.S.C. § 1225(b)(2). The parties are ORDERED to file a status report within 14 calendar days of this Order stating whether Petitioner has been granted bond, and, if his request for bond was denied, the reasons for that denial.(CEH) (Entered: 08/26/2026)

District Judge Angel Kelley: ELECTRONIC ORDER entered. On August 20, 2026 Petitioner Rodrigo Miranda de Amorim filed a Petition for a Writ of Habeas Corpus [Dkt. 1] and a Motion to Temporary Restraining Order [Dkt. 2] that challenged the lawfulness of Petitioner's detention and sought his immediate release. On August 26, 2026, this Court GRANTED Petitioner's Habeas Petition but did not address the Motion for Temporary Restraining Order. [Dkt. 11]. On September 9, 2026, Respondent provided a Status Report indicating that Petitioner was granted bond. [Dkt. 13]. As a result, absent objection within the next seven (7) calendar days, the Court will deny Petitioner's Motion for Temporary Restraining Order [Dkt. 2] as moot. If Petitioner wishes to collect EAJA fees, Petitioner shall inform the Court of their intent within the next seven (7) calendar days and submit an EAJA application within ninety (90) days of the grant of Petitioner’s Habeas Petition.
