TEXT ORDER: Petitioner Cruz Guachiac Guachiac, is a citizen of Guatemala who allegedly entered the United States without inspection in 2021. (ECF No. 1, Petition at 1.) Respondents have provided evidence that he was apprehended by U.S. Immigration and Customs Enforcement ("ICE") on August 14, 2026, in the interior of the United States. (ECF No. 5 -1, Ex. A (Form I-213) at 2.) On that same date, he was determined to be inadmissible under 8 U.S.C. §§ 1182(a)(6)(A)(i) as well as 1182(a)(7)(A)(i)(I) and was issued a Notice and Order of Expedited Removal pursuant to 8 U.S.C. § 1225(b)(1). (Id. at 2; Ex. B (Form I-860 Notice and Order of Expedited Removal).) According to the documentation, Petitioner did not express a fear of harm or persecution if returned to his home country. (Ex. A at 2.) Respondents are directed to file a full answer within 7 days. Given that Respondents' own documentation states that Petitioner entered without inspection at an unknown date and time and was arrested in the interior of the United States, the full answer shall provide the specific subsection of Section 1225(b)(1) that authorized Petitioner's detention on August 14, 2026, and provide all evidence and documentation supporting that determination.
