TEXT ORDER: The Court is in receipt of Respondents' response to the Court's Self-Executing Order. (ECF No. 4). In light of Respondents' representation that Petitioner is detained pursuant to 8 U.S.C. § 1225(b)(2), and this Court's decision in Bethancourt Soto v. Soto, 807 F. Supp. 3d 397 (D.N.J. 2025), among other cases, it appears to the Court, at a minimum, that Petitioner is being unlawfully detained under Respondents' repeated invocation of 8 U.S.C. § 1225. As explained in Bethancourt Soto, where, as here, a noncitizen was apprehended in the interior of the United States after residing here for an extended period, is not subject to a final order of removal, and has no criminal history requiring mandatory detention, detention is governed by 8 U.S.C. § 1226, which affords the noncitizen an opportunity to seek bond. Respondents do not assert that anything in Petitioner's history of law-enforcement encounters would require a different result or otherwise render him subject to mandatory detention. Accordingly, the Petition, (ECF No. 1), is GRANTED. Within twenty-four (24) hours of the entry of this Order, Respondents shall RELEASE Petitioner in accordance with the provisions and procedures set forth in the Self-Executing Order, (ECF No. 2), and file confirmation of Petitioner's release on the docket. All other applicable provisions of the Self-Executing Order shall remain in full force and effect. The Clerk of the Court shall CLOSE this case. So Ordered by Judge Christine P. O'Hearn on 8/25/2026.
