Order to Show Cause Pending is Petitioner Iran Damaris Echavarria Morales's Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 and Complaint for Emergency Injunctive Relief (ECF No. 1 ). On or before 1/2/2026 at 4:00 p.m. EST, Respondents shall serve and file an "Answer" to ECF No. 1 and show cause why the Petition should not be granted and the writ as prayed for issued. On or before 1/6/2026 at 12:00 p.m. EST, Petitioner shall file a "Brief in Response." The parties shall discuss the Court's decision in Lopez v. Raycraft, No. 4:25CV2449, 2025 WL 3280344 (N.D. Ohio 11/25/2025) (Pearson, J.), in their briefs. The Court will hold a Telephonic Hearing on 1/7/2026 at 3:00 p.m. EST, at which time counsel for Petitioner shall initiate a telephonic conference call to the Court at (330) 884-7435 with counsel for Respondents on the line. Memorandum of Opinion and Order For the reasons set forth herein, the Court conditionally grants the Petition for Writ of Habeas Corpus (ECF No. 1 ) under 28 U.S.C. § 2241. The Court Orders Respondents to provide Petitioner with a bond hearing under 8 U.S.C. § 1226(a) within 10 business days of the date of the Court's Memorandum of Opinion and Order or, in the alternative, immediately release Petitioner from custody. The Court also Orders Respondents to file a status rep ort within 14 business days of the date of the Court's Memorandum of Opinion and Order to certify compliance with this Order.
