TEXT ORDER This matter comes before the Court upon Pro Se Petitioner Luis Alvaro Laurent Quispe's petition for writ of habeas corpus under 28 U.S.C. 2241, challenging his immigration detention as unlawful. Petitioner has not paid the $5 filing fee required by 28 U.S.C. § 1914(a), nor has Petitioner submitted an application to proceed in forma pauperis under 28 U.S.C. § 1915(a), if he is unable to afford the filing fee. It is ORDERED that Respondents are enjoined from transferring Petitioner from New Jersey pending further order of the Court. Petitioner shall either: (1) pay the $5 filing fee; or (2) submit a properly completed IFP application within 14 days of this Order. The Clerk shall mail a copy of the docket sheet, along with an IFP Application (Form AO 239), to Petitioner by regular U.S. mail. TEXT ORDER terminating 3 Motion for TRO; terminating 5 Motion Respondents are hereby enjoined from transferring Petitioner from New Jersey pending further Order of the Court. If Respondents determine that Petitioner (1) does NOT have a criminal history, and (2) is NOT subject to a final order of removal, Respondents shall release Petitioner within twentyfour (24) hours of the entry of this Order. Within three (3) days after entry of this Order, Respondents shall file either: (a) a letter certifying Petitioner's release pursuant to this Order; or (b) a letter, not to exceed two pages, identifying (1) whether Petitioner has a criminal history, (2) whether Petitioner is subject to a final order of removal, and (3) the statutory authority under which Petitioner continues to be detained. Upon receipt of that letter, the Court will determine whether an expedited scheduling order or other proceedings are necessary. The Clerk shall administratively terminate as moot Petitioner's motion for temporary restraining order, Dkt. No. 3, and motion for release, Dkt. No. 5. The Court reserves Petitioner's motion to appoint pro bono counsel, Dkt. No. 4. The Clerk shall serve a copy of this Order, via the docket sheet, on Petitioner by regular U.S. mail.
