TEXT ORDER: This matter comes before the Court upon Petitioner Felix Apen Morales's petition for writ of habeas corpus under 28 U.S.C. § 2241 (ECF No. 1, Petition) alleging he has been unlawfully detained by immigration authorities since August 13, 2026. Respondents filed an answer in opposition to the Petition. (ECF No. 4, Answer). The record shows Petitioner is subject to a final order of removal dated March 17, 2012, reinstated upon his arrest and detention on August 13, 2026. (ECF No. 4-4, Notice of Intent to Reinstate Removal Order; ECF No. 4-2, Warrant of Removal). Therefore, it appears Petitioner falls within the 90-day removal period and is subject to mandatory detention. 8 U.S.C. § 1231(a)(1)(A), (a)(2). Accordingly, it is ORDERED that Petitioner shall SHOW CAUSE, in a reply brief filed within five (5) days, why the Court should not deny his Petition without prejudice because he is subject to a 90-day period of mandatory detention beginning August 13, 2026. IF Petitioner fails to file a reply within five (5) days, it is ORDERED that the Petition is DENIED without prejudice to seeking habeas relief if his detention becomes unreasonably prolonged.
