ORDER Granting in part and Denying in part 10 Motion to Extend Time.Petitioner Humberto Reyes Garcia moves for a modification of this court's order prohibiting the respondents from transferring him out of this district and seeks an extension of time to file an amended petition or motion to dismiss. 10 Reyes Garcia explains that he was ordered removed on August 20, 2026, and he does not plan to appeal that order. He asks that the court "modify its prior order to allow the government to transfer [him] from Nevada solely to promptly effectuate his removal." But the court's order prohibits the respondents from transferring Reyes Garcia "with the exception of effectuating the petitioner's lawful deportation." The order thus does not prohibit the respondents from lawfully removing Reyes Garcia under a valid removal order. So I deny the motion to the extent that is seeks a modification of the court's order.Reyes Garcia also seeks a 7-day extension of time to file an amended petition or a notice of voluntary dismissal, depending on the outcome of the respondents' removal attempts. With good cause appearing, that portion of the motion is GRANTED. Reyes Garcia must file an amended petition or a notice of dismissal by September 4, 2026.
