MINUTES (IN CHAMBERS) ORDER DISMISSING HABEAS-RELATED CLAIMS; CONVERTING ACTION TO CIVIL ACTION; GRANTING PLAINTIFF ETINOSA OSAHON'S (A No. 055-039-712) EX PARTE APPLICATION FOR TEMPORARY RESTRAINING ORDER AND ORDER TO SHOW CAUSE (DKT. 2 ); ORDERING RESPONDENTS TO SUBMIT DECLARATION RE: PETITIONER'S CUSTODIAL STATUS AND RESPOND IN WRITING TO OSC; AND SETTING HEARING ON ORDER TO SHOW CAUSE by Judge Michelle Williams Court Granting 2 EX PARTE APPLICATION for TRO: For the foregoing reasons, the Court ORDERS as follows: 1. Plaintiff Etinosa Osahon's (A No. 055-039-712) Ex Parte Application for Temporary Restraining Order (Dkt. No. 2) is GRANTED. Defendants are ENJOINED from taking further action to effectuate, procure, encourage, facilitate, or acquiesce in Plaintiff's removal or transfer to Nigeria. The Court further ORDERS Defendants to preserve all records relating to Plaintiff's detention, transfer, and removal. 2. Plaintiff's habeas-related claims are DISMISSED WITHOUT PREJUDICE. General Order No. 26-05 does not apply to this matter, and the Court WITHDRAWS all referrals to U.S. Magistrate Judge McCormick unless otherwise noted. 4. Within fourteen (14) days of this Order, Plaintiff SHALL file either (1) an amended civil Complaint; or (2) an objection to the Court's conversion, accompanied with a Notice of Voluntary Dismissal pursuant to Federal Rule of Civil Procedure 41(a), indicating that Plaintiff intends to dismiss the action without prejudice and refile the action as a non-habeas civil matter. 5. ORDER GRANTING PLAINTIFF'S EX PARTE APPLICATION TO ENFORCE PRELIMINARY INJUNCTION AND PRIOR ORDERS (DKT. 68 ) by Judge Michelle Williams Court. Good cause appearing, the Application is GRANTED. Restoration on arrival. Upon Plaintiff's arrival at Los Angeles International Airport on October 15, 2026, Defendants SHALL restore Plaintiff to the order-of-supervision posture he held immediately before the May 2026 detention and removal, as paragraph 5 of the Preliminary Injunction requires. Upon completing his inspection, Defendants SHALL parole Plaintiff for a period ending no earlier than October 30, 2026, Dkt. # 60 2, and SHALL release him from LAX the same day. Defendants SHALL NOT take Plaintiff into custody or detain him beyond the time reasonably required to complete his inspection. Any reissuance of his Form I-220B shall take place without detention. Defendants SHALL NOT treat Plaintiff's court-ordered return as an application for admission, and SHALL NOT use his inspection, his parole, or his arrival as a basis to detain him or to revoke his Order of Supervision. No transfer. Pending further order of this Court, Defendants SHALL NOT transfer or remove Plaintiff from the Central District of California. Before Plaintiff's arrival, Defendants SHALL instruct in writing Larry C. Stanback, Watch Commander, CBP, LAX; Defendant Thomas Giles, Field Office Director, ERO Los Angeles Field Office; Juan A. Gutierrez, Supervisory Detention and Deportation Officer; and Ronald I. Campbell, Unit Chief, ICE Parole and Law Enforcement Unit, to comply with this Order, and SHALL file copies of those instructions by 9:00 a.m. on October 15, 2026. If Plaintiff is held in custody at any time on October 15, 2026, Defendants, as his custodian, SHALL produce him in person in Courtroom 6A at 1:30 p.m. that day to testify at the hearing.
