ORDER REGARDING BRIEFING SCHEDULE AND DENYING MOTION TO APPOINT COUNSEL by Judge Stanley Blumenfeld, Jr: If the government does not oppose the relief sought in the habeas petition, it shall promptly notify the Court. Otherwise, the government shall file a response by August 20, 2026, and Petitioner shall file any reply no later than September 3, 2026. The Court denies Petitioner's motion for appointment of counsel (Dkt. No. 2 ) because he has not shown that he is unable to articulate his claims pro se, when taking into account the complexity of the legal issues involved and his likelihood of success on the merits. See Weygandt v. Look, 718 F.2d 952, 954 (9th Cir. 1983). See document for further information. (es) (Entered: 08/14/2026)

(In Chambers) Order by Judge Stanley Blumenfeld, Jr.: The government has notified the Court that an immigration judge ordered Petitioner removed to Mexico on September 18, 2026, and that Petitioner waived appeal. Because Petitioner waived appeal, the removal order became administratively final that day. See 8 C.F.R. § 1241.1(b). His detention is therefore governed by 8 U.S.C. § 1231(a), which requires detention during the 90-day removal period, rather than § 1226(a). Accordingly, his request for a § 1226(a) bond hearing is moot, and his challenges to his initial arrest and detention do not establish a basis for release from his present detention under § 1231(a). The petition is therefore denied, except that the request for a § 1226(a) bond hearing is dismissed as moot. A separate judgment will issue. THERE IS NO PDF DOCUMENT ASSOCIATED WITH THIS ENTRY.
