The Court orders Ilongo to file an amended petition, on or before August 27, 2026, adequately alleging the nature of his entry into the United States and whether he is an applicant for admission under 8 U.S.C. § 1225(a)(1). The petition names the sole respondent as Phillip Valdez in his capacity as warden of the Eden Detention Facility. Dkt. No. 6 at 1. ORDER TO SHOW CAUSE AND SETTING BRIEFING SCHEDULE. The Court grants the motion (Dkt. No. 11 ) and deems the amended petition at Dkt. No. 9 to be the live pleading in this case. The respondent is ordered to file an answer that shows cause why Ilongo's writ should not be granted, and the Court finds good cause to give the respondent 20 days to respond to this Show-Cause Order. Ilongo may file a reply brief no later than two weeks from the date the respondent files her answer. The respondent is ordered to file, by no later than 5:00 p.m. CT on September 10, 2026, a notice addressing whether the government will commit not to remove Ilongo pending the Court's resolution of his habeas petition (Dkt. No. 9 ). Copies of all pleadings, motions, and orders will be served electronically upon the United States Attorney for the Northern District of Texas, pursuant to Fed. R. Civ. P. 5(b)(2)(E) and by prior agreement of the Office for the United States Attorney for the Northern District of Texas. The Clerk shall mail a copy of this order to Ilongo or his attorney of record. The clerk has served this order and will regenerate notice of the petition and supporting documents to the designated Assistant US Attorney.
