Minute Order of Telephone Status Conference held on 8/13/2026. regarding Petitioner's recently filed Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 (ECF No. 1 ) and his Emergency Motion to Stay Removal (ECF No. 3 ). Counsel for the parties agreed and the court ordered that Respondents file a Response to the Motion to Stay Removal by August 27, 2026. Should counsel for Petitioner wish to file a Reply, she shall do so by September 3, 2026. Minutes of proceedings before Judge Solomon Oliver, Jr. An Emergency Telephone Status Conference was held on 8/20/2026 at 9:15 a.m. Counsel for Respondents also shared that she was not informed that Petitioner's travel papers had been finalized until today because the ICE officials responsible for transporting Petitioner apparently did not know about Petitioner's pending § 2241 habeas action, and therefore did not tell the ICE attorneys aboutPetitioner's imminent removal. Despite Petitioner's active removal, the court finds that briefing from the parties, including additional documentation related to Petitioner's immigration proceedings, is necessary to complete the record. Accordingly, Respondents shall file a brief with exhibits by 5:00 p.m. on August 21, 2026. Order granting Motion for order (Related Doc # 3 ). Based on the limited record before the court, and the urgency with which it must decide the issue, the court hereby enters a stay of Petitioner's deportation proceedings for a period of 14 days. The fourteen days will allow the court an opportunity to receive further submissions from the parties and conduct a more fulsome review of the evidence presented to determine whether the stay should remain in place, or be vacated. Counsel for Respondents shall immediately send a copy of this Order forthwith to ICE, specifically those who are responsible for removing Petitioner. Minute Order of Status Conference held on 8/28/2026. The court held a telephonic status conference on the record with counsel for the parties in the above-captioned case on 8/28/2026 at 2:00 p.m., to discuss a briefing schedule on Petitioner's Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 (ECF No. 1 ). A week prior, on 8/20/2026, the court issued an Order of Stay thereby staying Petitioner's imminent removal from the United States for 14 days so that the court could receive further submissions from the parties and make a final decision on the Petition based on a more complete record. The court grants Petitioner's oral motion for leave to amend the Petition, and grants Respondents oral motion to file those documents containing sensitive information under seal. Petitioner shall file the Amended Petition by 9/9/2026. Respondents shall file a Response by 9/14/2026. Petitioner may file a Reply by 9/21/2026. Given the complex nature of the issues raised in this case, and the extended briefing schedule, the court hereby extends its Order of Stay for 45 days from the date of this order.
