TEXT ORDER: Currently pending before the Court is a Petition for a writ of habeas corpus brought pursuant to 28 U.S.C. § 2241. The Petition contends that Petitioner is unlawfully detained under 8 U.S.C. § 1225(b)(2) as an applicant for admission. (ECF No. 1, Petition at 5.) In their expedited answer, Respondents have provided evidence that Petitioner was arrested pursuant to a warrant and is detained under § 1226(a) but has not sought a bond hearing. (ECF No. 6, 6-4.) Within three (3) days of the date of this Order, Petitioner shall file a reply clarifying whether he has sought a bond hearing. If not, Petitioner shall SHOW CAUSE why this matter should not be dismissed for failure to exhaust available administrative remedies. So Ordered by Judge Robert Kirsch on 08/18/2026.
