REPORT AND RECOMMENDATION issued by Magistrate Judge Daniel S. Roberts Re Petition for Writ of Habeas Corpus 1 . In light of the agreement of the parties, IT IS THEREFORE RECOMMENDED that the District Judge issue an Order accepting and adopting this Report and Recommendation and GRANTING the Petition on the following terms: (a) that Respondents be ordered to provide Petitioner an individualized custody redetermination hearing pursuant to 8 U.S.C. § 1226(a) within seven (7) days of the Court's Order; (b) that if no such hearing is provided, or the Immigration Judge still determines that he or she does not have jurisdiction to consider bond for Petitioner, notwithstanding not only the binding Judgment in Maldonado Bautista v. Santacruz, No. 5:25-cv-01873-SSS-BFM, 2025 WL 3288403 (C.D. Cal. Nov. 25, 2025), and now the Ninth Circuit's decision in Rodriguez-Vasquez v. Bostock, then Respondents are ordered to release Petitioner immediately; and (c) that Respondents shall file a Status Report with the Court within 14 days of the Court's Order granting the Petition to inform the Court whether the bond hearing occurred, and if so, the outcome of that hearing.
