Minute Entry for Zoom Status Conference held on 9/15/2026 before Magistrate Judge Lawrence R. Leonard. Hale Hawbecker appeared on behalf of Petitioner. Elizabeth Spavins, AUSA, appeared on behalf of Respondent. The Court requested this hearing to determine what is happening in the case. Petitioner filed a Stipulation of Dismissal and Govt filed notice that this case is duplicative of Alexandria case. Mr. Hawbecker explains his delayed response and that the Stipulation of Dismissal was not intended to dismiss the petition. He requests that Norfolk maintain jurisdiction. The Court questions why there are two petitions. Mr. Hawbecker was unaware that the petitioner filed pro se in Norfolk. Mr. Hawbecker filed a case in Alexandria after numerous attempts to contact petitioner. Ms. Spavins informs the court that the cases are identical and there has been no decision in the Alexandria case. The issue of criminal charges would be handled by the Immigration Court. As far as the Stipulation of Dismissal, per conversations through email, she understood Mr. Hawbecker intended to dismiss the Norfolk case. Because the Alexandria case is further along, the Court will issue an R&R that the Norfolk case be dismissed. R&R to be issued. Court adjourned.
