TEXT ORDER: The Court is in receipt of Respondents' letter advising that Petitioner was transferred from New Jersey before entry of the Court's no-transfer Order. (ECF No. 5). The factual assertions in the letter, however, are not supported by a certification from an official with personal knowledge. Respondents also do not state whether they intend to seek dismissal or transfer of this matter based on Petitioner's relocation. Accordingly, by Wednesday, July 29, 2026, at 5:00 p.m., Respondents shall: (1) submit a certification from an official with appropriate knowledge detailing Petitioner's initial transfer outside this District, any subsequent transfers, and his current location; and (2) state whether they intend to seek dismissal or transfer of the Petition and, if so, provide appropriate legal authority and analysis supporting the requested relief. Petitioner shall respond to Respondents' submission by Friday, July 31, 2026, at 5:00 p.m. If Respondents seek transfer of this matter, Petitioner shall state whether he opposes that request and identify any supporting legal authority for their position. TEXT ORDER: In light of Buele Morocho v. Warden Philadelphia FDC, Nos. 26-1150 & 26-1454 (3d Cir. Aug. 28, 2026), and because the Court is considering the appropriate remedy, Respondents shall, within 7 days, file a supplemental notice stating whether Petitioner has any criminal history or other history that Respondents contend bears on whether Petitioner presents a danger to the community or a risk of flight.
