MINUTE ORDER signed by District Judge Noel Wise on 8/4/2026: Upon review of the petition for writ of habeas corpus 1, it appears Petitioner's detention is controlled by 8 U.S.C. § 1226(a). See Rodriguez Vazquez v. Bostock, No. 25-6842, 2026 WL 2196424 (9th Cir. July 30, 2026). Under this provision, Petitioner is entitled to a bond hearing upon request. Indeed, Petitioner explains in the instant petition that he "does not seek immediate release through this Petition" and instead "requests that this Court order Respondents to provide him with a prompt, individualized custody determination before an Immigration Judge to determine whether his continued detention is necessary." ECF No. 1 at 10. Accordingly, Respondents are ordered to show cause by 8/7/2026, in writing, why the instant petition should not be granted and Respondents ordered to provide Petitioner with a prompt custody hearing.
