Minute Order by District Judge Robert S. Huie: The Petition, filed on August 2, 2026, claims that the government has withheld a credible fear interview from Petitioner, resulting in his unlawful detention. The governments return states that on August 4, 2026, Petitioner in fact received a credible fear hearing; that his credible fear determination remains pending; and that in the interim Petitioner is subject to mandatory detention under 8 U.S.C. 1225(b)(1)(B)(iii)(IV). Petitioners traverse requests, inter alia, that the government make a supplemental filing explaining the final status of the credible-fear determination, and the precise statutory authority presently governing custody.
