(In Chambers) Order by Judge Stanley Blumenfeld, Jr.: Petitioner has filed a petition for a writ of habeas corpus. If the government does not oppose the requested relief, it shall promptly notify the Court. Otherwise, by August 10, it shall file a response addressing the petition's arguments, attaching relevant documents concerning Petitioner's detention. Failure to substantively address the petition's arguments may be construed as consent to granting the requested relief. Petitioner shall file any reply by August 24, or earlier if practicable to facilitate prompt resolution. The reference to the assigned magistrate judge is vacated pursuant to General Order 05-07. The Court denies Petitioner's motion for appointment of counsel because he has not shown that he is unable to articulate his claims pro se, when taking into account the complexity of the legal issues involved and his likelihood of success on the merits.
