ORDER temporarily granting 3 Letter Motion for Leave to File Document. On July 31, 2026, Petitioner filed a motion seeking to proceed under the pseudonym "J.V.B." See ECF No. 3. The motion is GRANTED temporarily. Respondents and any nonparty who seeks, and is granted, leave to intervene for purposes of being heard on the issue shall file any opposition to the motion within two weeks of Respondents' entering a notice of appearance; any reply shall be filed within one week of any opposition. In the meantime, the Court reserves judgment on whether to grant the motion on a more permanent basis. To ensure that the Court has no conflicts that would require recusal, Petitioner shall promptly file, under seal, a declaration disclosing his identity to the Court. To ensure that his name does not appear on the public docket, Plaintiff's counsel should ensure that the declaration is titled "Declaration of J.V.B." ORDER: As stated on the record during the teleconference held earlier today: On consent of the parties, the writ of habeas corpus is GRANTED and, no sooner than seven days and no later than fourteen days from the date of this Order, the immigration court is ORDERED to hold an individualized bond hearing at which the burden is on the Government to show, by clear and convincing evidence, the need for Petitioner's continued detention and the Immigration Judge is required to consider his ability to pay and alternative means of assuring his appearance. No later than August 19, 2026, Respondents shall file a letter with the Court certifying that Petitioner has received such a bond hearing and the results of the hearing. The Court reserves judgment on whether Petitioner is entitled to immediate release. Petitioner shall file any brief in support of his position that that is the appropriate form of relief no later than August 7, 2026.
