MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 8/14/2026.Before the Court is Petitioner's Motion for Leave to Proceed in Forma Pauperis (ECF No. 9 ) and First Amended Petition for Writ of Habeas Corpus (ECF No. 10 ).As a preliminary matter, the Court DEFERS its decision on Petitioner's Motion for Leave to Proceed in Forma Pauperis, as Petitioner has seemingly filed a duplicate of his First Amended Petition. See generally First Am. Pet. Under 28 U.S.C. § 2241, ECF No. 9 (Aug. 13, 2026). Petitioner has up to, and including, August 20, 2026, to file a proper application for leave to proceed in forma pauperis. Petitioner may do so using the "Notice of Corrected Image/Document" event in CM/ECF.With that being said, the Court has preliminarily reviewed Mr. Robles Ramos's First Amended Petition and finds that he may be entitled to relief under: (i.) Jacobo-Ramirez v. Mullin, --- F. Supp. 3d ---, 2026 WL 879799 (D. Nev. 2025); (ii.) the Immigration and Nationality Act; and (iii.) the Due Process Clause of the Fifth Amendment. Therefore, Respondents are ORDERED TO SHOW CAUSE for Petitioner's detention. See 28 U.S.C. § 2243. Specifically, Respondents must file a "return certifying the true cause of [Petitioner's] detention" by August 17, 2026. Id. If Respondents fail to identify a specific authority that authorizes Petitioner's detention, the Court may "fortwith award the writ" Petitioner seeks.
