District Judge F. Dennis Saylor, IVELECTRONIC ORDER entered:Petitioner’s motion for reconsideration, Dkt. No. 13, is GRANTED IN PART and DENIED IN PART. Petitioner has informed the Court that she has a custody redetermination hearing before the Chelmsford Immigration Court scheduled for August 10, 2026. Petitioner lives in Maine, and her counsel is also based in Maine. Accordingly, it would represent a gross inconvenience, at the very least, to transfer petitioner to Louisiana before that custody redetermination hearing has taken place, and could meaningfully impact her and her counsel’s ability to effectively prepare for and participate in that hearing.Therefore, the Court’s earlier order, Dkt. No. 11, is modified as follows: Petitioner shall not be transferred outside of New England before her custody redetermination hearing before the Chelmsford Immigration Court on August 10, 2026. Following that hearing, if the immigration judge determines, applying the standard set out in Hernandez-Lara v. Lyons, that petitioner should remain in custody, the government may transfer her to Louisiana on or after the date of that determination.(MAC) (Entered: 08/05/2026)
