ORDER TO SHOW CAUSE - The Court, having considered the above action and the matters which are pending, makes the following rulings. The respondents are notified of the filing of the petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2241. This material has been scanned into the Court's electronic docket. A copy of this Order to Show Cause, the petition, memorandum in support, and exhibits shall be distributed electronically to the United States Attorney. The clerk is directed to issue process by mail to the Clay County Respondent. Process will consist of the petition, exhibits, and emergency motion for temporary restraining order (dkt. 1, dkt. [1-3], and dkt. 2 ), and this Order. The respondents will have seven days from the date service is made or waived to answer the allegations of the habeas petition and show cause why the relief sought by the petitioner should not be granted, and respond to the motion for temporary restraining order at docket 2. The petitioner will have four days after service of the answer to reply. The clerk is directed to include a blank financial affidavit with this order. If the petitioner wants the Court to consider appointing counsel, the petitioner must complete and return the affidavit no later than August 7, 2026. The affidavit should be filed ex parte. Petitioner's request for dual service, dkt. 3, in which he asks for all orders to be mailed to both the Clay County Justice Center and his home address, is denied. As a courtesy, the clerk is directed to send a courtesy copy to Petitioner's home address on this one occasion. *** SEE ORDER ***. Signed by District Judge Justin R. Olson on 7/31/2026.
