Judge Mark G. Mastroianni: Electronic order entered re 1 Emergency Petition for Writ of Habeas Corpus. The government shall file a response by August 14, 2026. Moreover, the court notifies the parties that the undersigned served as the Hampden County District Attorney in 2011 when Petitioner admitted to violating probation arising out of the 2007 home invasion and assault and battery convictions. See Commonwealth v. Innis, 50 N.E.3d 219, 2016 WL 2864479, at *1 (Mass. App. Ct. May 17, 2016) (unpublished) ("On June 30, 2011, the defendant admitted to violating probation on the 2007 convictions, and the Superior Court trial judge imposed the minimum mandatory sentence of twenty years."). Although the court does not believe this circumstance creates an actual conflict, given the passage of time and the undersigned's lack of memory about and individual involvement in Petitioner's underlying state court cases, the parties shall notify the court in writing, by August 14, 2026, as to their positions in this regard.(TF) (Entered: 07/31/2026)
