MINUTE ORDER by Judge Philip A. Brimmer on 8/18/2026 re: 7 Petitioner's Proof of Service Upon Respondents by Electronic and Overnight Mail Pursuant to the Court's Order. On July 31, 2026, Magistrate Judge Neureiter ordered petitioner to serve respondents by e-mail and overnight mail. Docket No. 4 at 1. Petitioner received an extension of time to file proof of service and did so on August 12, 2026. See Docket Nos. 7, 8 . However, there is no evidence that petitioner served the U.S. Attorney's Office for the District of Colorado. See generally Docket No. 7 . While petitioner served Assistant United States Attorney Alicia Walker by e-mail, see id. at 5, there is no evidence that petitioner served the U.S. Attorney's Office by overnight mail as required by Magistrate Judge Neureiter's July 31, 2026 Order. See id. at 18-22. "Rule 4(i) of the Federal Rules of Civil Procedure requires that, in order to properly serve the United States or its agencies, corporations, or officers, a plaintiff must deliver a copy of the summons and the complaint to the U.S. Attorney's Office for the district in which the action is brought, as well as to the Attorney General of the United States." Duhan v. Noem, 2026 WL 74195, at *2 (D.N.M. Jan. 9, 2026). On or before August 20, 2026, petitioner shall serve the U.S. Attorney's Office for the District of Colorado in accordance with Fed. R. Civ.
