MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 8/3/2026.Before the Court is a Joint Petition for Writ of Habeas Corpus (ECF No. 1 ) (the "Petition") and Joint Petitioners' motion to proceed in forma pauperis (the "IFP Application") (ECF No. 3 ).In its initial screening of the Joint Petition, the Court noted that many Petitioners had parallel proceedings in this District, and ordered Petitioners to file a notice indicating which Petitioners intended to proceed with the instant case. See ECF No. 5 . In Petitioners' notice, ECF No. 6, Petitioner Jose Mario Gonzalez Amaro represented that he wished to continue with his pending proceeding in front of the Honorable Judge Navarro. See ECF No. 6 at 3. Accordingly, IT IS HEREBY ORDERED that Petitioner Jose Mario Gonzalez Amaro will be DISMISSED from this action. See Fed. R. Civ. P. 81(a)(4); Fed. R. Civ. P. 41(a)(2).Next, after reviewing Petitioners' financial circumstances as represented in the IFP Application, the Court finds good cause to grant the motion. Thus, IT IS HEREBY ORDERED that the IFP Application (ECF No. 3 ) is GRANTED as to the remaining Joint Petitioners.After reviewing the Petition, the Court preliminarily finds that each Joint Petitioner may be entitled to habeas relief under: (i.) Jacobo Ramirez v. Mullin, --- F. Supp. 3d ---, 2026 WL 879799 (D. Nev. Mar. 30, 2026); (ii.) the Immigration and Nationality Act; and (iii.) the Due Process Clause of the Fifth Amendment.Therefore, Respondents are ORDERED TO SHOW CAUSE for Petitioners' detention. See 28 U.S.C.§ 2243. Specifically, Respondents must file a "return certifying the true cause of detention" on or before August 6, 2026. In doing so, Respondents should not re-argue their faulty interpretation of 8 U.S.C. § 1225(b)(2)(A), as this issue has already been litigated in, and decided by, this Court and the Ninth Circuit. See generally Jacobo Ramirez, 2026 WL 879799 (D. Nev. Mar. 30, 2026); Rodriguez Vazquez v. Bostock, --- F.4th ---, 2026 WL 2196424 (9th Cir. July 30, 2026). Finally, if Respondents intend to rely on a separate source of detention authority, they must identify it in their return.IT IS FURTHER ORDERED Respondents must file a supplement which answers the following interrogatories under oath, see Rule 7, Rules Governing § 2254 Proceedings in the United States District Courts: (1.) Was Petitioner arrested pursuant to a lawfully executed, and served, administrative warrant pursuant to 8 C.F.R. § 236.1(b)? (2.) MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 8/14/2026.Before the Court is Petitioners' Joint Petition for Writ of Habeas Corpus (ECF No. 1 ) and Joint Traverse Supporting the Joint Petition (ECF No. 9 ). On July 30, 2026, the Court instructed Petitioners to file a notice indicating which Petitioners intended to proceed with the instant joint petition. See Screening Order, ECF No. 5. On July 31, Petitioners filed a notice stating their intent to proceed with the group petition, with the exception of Petitioner Jose Mario Gonzalez Amaro. See ECF No. 6 at 2-3. However, as of the entry of this Order, Petitioner Tomas Robles Carillo appears to have a pending case before this Court. See Carrillo v. Blanche, No. 2:26-cv-02223-RFB-DJA. For the sake of judicial economy, IT IS HEREBY ORDERED that Petitioners file an amended joint petition limited to the petitioners that intend to proceed in this case by August 19, 2026.Additionally, the Court notes that Respondents have not yet appeared in this case to-date. Thus, the Clerk of Court is kindly INSTRUCTED to ADD the United States Attorney for the District of Nevada to the docket as an Interested Party. MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 8/19/2026.Before the Court is Petitioners' Joint Amended Petition for Writ of Habeas Corpus (ECF No. 12 ) (the "Petition"). After reviewing the Petition, the Court preliminarily finds that each Joint Petitioner may be entitled to habeas relief under: (i.) Jacobo Ramirez v. Mullin, --- F. Supp. 3d ---, 2026 WL 879799 (D. Nev. Mar. 30, 2026); (ii.) the Immigration and Nationality Act; and (iii.) the Due Process Clause of the Fifth Amendment.Therefore, Respondents are ORDERED TO SHOW CAUSE for Petitioners' detention. See 28 U.S.C. § 2243. Specifically, Respondents must file a "return certifying the true cause of detention"--that is, the specific statutory provision they contend governs Petitioners detention--on or before August 21, 2026. In doing so, Respondents should not re-argue their faulty interpretation of 8 U.S.C. § 1225(b)(2)(A), as this issue has already been litigated in, and decided by, this Court and the Ninth Circuit.
