ORDER. IT IS ORDERED that Petitioner has seven days from the date of this Order to file an amended petition identifying the facility where Petitioner is being detained and naming the warden of said facility as a Respondent. IT IS FURTHER ORDERE D that the 1 Petition is deferred. IT IS FURTHER ORDERED that the Clerk of Court add the USAO to the docket as an Interested Party. MINUTE ORDER IN CHAMBERS of the Honorable Judge Miranda M. Du on 8/18/2026. Respondents filed a first motion to extend time to respond to Petitioner's petition for writ of habeas corpus and motion for Temporary Restraining Order ("TRO"). (ECF No. 11 (Motion).) Respondents request a seven-day extension citing the fact-intensive nature of the case and the time needed to gather non-digital records. (Id.) Petitioner opposes the Motion, citing ongoing injury from the delay, Respondents' responsibility for detaining Petitioner before conducting due diligence, and Respondents' apparent familiarity with Petitioner's case based on social media posts by the Department of Homeland Security. (ECF No. 12 .) Respondents filed the Motion at 7:38 P.M. on August 17, 2026, the day their response was due. This is now the fourth time this counsel has filed for an extension on the same date as the deadline, despite three prior orders advising counsel that this practice is disfavored. See Mendez v. Blanche et al., Case No. 2:26-cv-01854-MMD-BNW (D. Nev. July 29, 2026) (ECF No. 12); Rodriguez v. Mattos, Case No. 2:26-cv-02125-MMD-DJA (D. Nev. July 31, 2026) (ECF No. 8); Luis Manuel Hernandez Cortes v. Mattos, Case No. 2:26-cv-01869-MMD-MDC (D. Nev. Aug. 7, 2026) (ECF No. 14). The Court once again finds this practice inhibits finding good cause. However, the Court finds it would benefit from a "comprehensive response" from Respondents. (ECF No. 11 at 1.) The Court therefore denies in part and grants in part the Motion. (ECF No. 11 .) Respondents have until Friday, August 21, 2026 to file their response to the second amended petition (ECF No. 8 ) and the motion for TRO (ECF No. 2 ).
