(Text-Only) ORDER denying (2) Motion for TRO; denying (3) Motion for Immediate Release from Immigration Detention in case 0:26-cv-04649-KMM-DLM.Petitioner has filed a new petition for a writ of habeas corpus. In addition, he has filed a motion for a temporary restraining order (TRO) (No. 0:26-cv-04649 2 ) staying his removal from the United States, and a Motion for Immediate Release from Immigration Detention (No. 0:26-cv-04649 3 ), which the Court also construes as a request for a TRO. Both motions are denied at this time. Petitioner has not met his burden to show a likelihood of success on the merits. Tumey v. Mycroft AI, Inc., 27 F.4th 657, 664-65 (8th Cir. 2022). The Court will take the merits of the habeas petition (No. 0:26-cv-04649 1 ) seeking release from custody under advisement. Based on the record developed in connection with Petitioner's first petition for a writ of habeas corpus (Case No. 0:26-cv-03433-KMM-DLM), Respondents are not required to respond to this new petition at this time.
