Judge Brian E. Murphy: ELECTRONIC ORDER entered. Respondents acknowledge that Petitioner is detained under 8 U.S.C. s. 1226(a) (“section 1226(a)”). Dkt. 6 at 1. Though noncitizens detained under section 1226(a) are eligible for a bond hearing, Romero v. Hyde, 795 F. Supp. 3d 271, 281 (D. Mass. 2025), Respondents argue that Petitioner failed to exhaust his administrative remedies by failing to seek a bond hearing before an Immigration Judge (“IJ”), Dkt. 6 at 2, 4. The Court construes—and ORDERS Respondents to likewise construe—the pending petition as conveying a request for a bond hearing before an IJ. The Court further ORDERS that such a hearing shall be held on or before Wednesday, August 5, 2026. Respondents are further ORDERED to file a status report within 24 hours of the issuance of the IJ’s written decision, notifying the Court of whether a bond hearing has occurred and, if so, its outcome, and shall include a copy of any written order of the immigration judge.
