PAPERLESS ORDER. On June 30, 2026, Daniel Cuervo Gonzalez filed an Emergency Motion to Protect Petitioner's Access to the Court ("Motion") [ECF No. 7]. After careful review, we'll DENY the Motion. First, the Motion is procedurally defective. Our Local Rules require a party filing an emergency motion to certify that the motion "in fact presents a true emergency" and "requires an immediate ruling because the Court would not be able to provide meaningful relief... after the expiration of seven days." S.D. Fla. L.R. 7.1(d)(1). But Gonzalez didn't certify that his Motion was a true emergency and has therefore violated Local Rule 7.1(d). Second, Gonzalez requests relief he isn't entitled to. He asks that we "take note of his emergency circumstances[.]" Mot. at 2. But aside from reviewing the docket, we're not sure what else we can do. He asks that we "ensure [he] is able to receive Court mail and respond to any orders." Ibid. But there's no evidence that the Respondent failed to provide Gonzalez with filings--so we'll do no more than remind the Respondent of its obligation to provide Gonzalez full and complete copies of all documents filed in support of its response. Rodriguez v. Fla. Dep't of Corrs., 748 F.3d 1073, 1077 (11th Cir. 2014) ("[A]ll documents referenced in the State's answer and filed with the Court must be served on the habeas petitioner."). He also asks that we "order the Government to confirm [his] current custody location." Mot. at 2. But we've already directed the Respondent to brief that question. See Order to Show Cause [ECF. No. 12]. Finally, he asks that we "order the Government not to transfer" him. Mot. at 2. But he hasn't proved that he's entitled to an injunction. A petitioner seeking a preliminary injunction must establish that: (1) he is likely to succeed on the merits, (2) he is likely to suffer irreparable harm in the absence of preliminary relief, (3) the balance of equities tips in his favor, and (4) an injunction is in the public interest. Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7, 20 (2008). The Motion doesn't address, much less establish, any of these four requirements. Gonzalez is therefore not entitled to a preliminary injunction. Accordingly, Gonzalez's Emergency Motion to Protect Petitioner's Access to the Court [ECF No. 7] is DENIED. Signed by Judge Roy K.
