ORDER re: 1 Emergency PETITION for Writ of Habeas Corpus filed by Anderson Stalin Lasso Yuquilema. TEXT ORDER: The Petitioner has filed a Petition for Writ of Habeas Corpus (ECF No. 1 ) arguing that his arrest and continued detention by immigration officials is unlawful, and that he must be released or given a bond hearing before an immigration judge under 8 U.S.C. § 1226(a). The Government responded to the Petition, providing "ICE acknowledges that pursuant to Cunha v. Freden, No. 25-3141-pr (2nd Cir. Apr. 28, 2026), Petitioner is eligible for a bond hearing. ERO has submitted the Notice to Appear and accompanying I-286 form. Respondents anticipate the immigration court to accept these filings in short order and schedule a bond hearing before an immigration judge. For these reasons, the United States respectfully requests that this Court hold the matter in abeyance to allow Petitioner to appear before an immigration judge on the issue of bond." Consistent with this request, this matter is HELD IN ABEYANCE until resolution of Petitioner's bond hearing. The parties shall provide a status report to this Court within 48 hours of the conclusion of that hearing stating whether the Petitioner's request for bond was granted or denied and, if denied, the reasons for the denial.
