ENDORSED ORDER: The motion for temporary restraining order (Doc. 2) is DENIED without prejudice. The motion fails to comply with the Local Rule 6.01(a) and with Federal Rule of Civil Procedure 65(b)(1). Further, the petitioner, an adult, provides no reason why he should be granted leave to proceed pseudo anonymously, particularly as the entire action remains under seal. Importantly, the lack of clear identification of the petitioner precludes this Court from granting injunctive relief because it impedes the Court's ability to enforce its own order against the defendants. See Fed. R. Civ. P. 65(d)(1)(B)-(C) (requiring every order granting an injunction or restraining order to "state its terms specifically" and "describe in reasonable detail--and not by referring to the complaint or other document--the act or acts restrained or required"); S.E.C. v. Goble, 682 F.3d 934, 950 (11th Cir. 2012) ("As the Supreme Court has explained, the specificity requirements of Rule 65(d) are 'designed to prevent uncertainty and confusion on the part of those faced with injunctive orders, and to avoid the possible founding of a contempt citation on a decree too vague to be understood.' ENDORSED ORDER: Like the first motion that the Court denied, the second motion for temporary restraining order (Doc. 5) does not include "specific facts in an affidavit or a verified complaint." See Fed. R. Civ. P. 65(b)(1)(A). That failure alone justifies denial of a temporary restraining order. Petitioner's counsel represents that she notified the respondents prior to filing any temporary restraining order that she would file "a petition and complaint" but has not provided reasons why notice to the respondents or an opportunity to be heard should not be required before any such order is issued. See (Doc. 5) at 6; Fed. R. Civ. P. 65(b)(1)(B). In an effort to expedite review on the merits and avoid further delay based on procedural deficiencies in the petitioner's motions, the Court construes the second motion for a temporary restraining order as one seeking a preliminary injunction and directs the Clerk to IMMEDIATELY send a copy of this endorsed order, the petition for a writ of habeas corpus (Doc. 1), and the second motion for temporary restraining order (Doc. 5) to the United States Attorney's Office in Tampa, Florida at USAFLM.Alcatraz@usdoj.gov, and the United States Immigration and Customs Enforcement at OPLAORLFEDLIT@ice.dhs.gov, and by first class mail to the Attorney General of the United States at United States Department of Justice, 950 Pennsylvania Avenue, NW, Washington, DC, 20530-0001.
