TEXT ORDER: The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 and Motion for Order to Show Cause filed by Petitioner, Reoland Preka ("Petitioner") who is presently detained at Delaney Hall Detention Facility in Newark, New Jersey. (ECF Nos. 1, 2.) According to the petition, Petitioner is a native and citizen of Albania who entered the United States on March 29, 2017, after inspection and admission pursuant to a valid B-1/B-2 nonimmigrant visa. (ECF No. 1.) Petitioner alleges he thereafter filed an affirmative asylum application, which remains pending before USCIS, and he has resided in the United States with his wife and two children while complying with applicable immigration requirements. Petitioner further alleges that on July 21, 2026, Petitioner returned to John F. Kennedy International Airport following domestic travel from Las Vegas, Nevada, where DHS-ICE officers detained Petitioner upon his arrival, despite his pending asylum application and the fact that he was returning from domestic, rather than international, travel. Petitioner further alleges that he was subsequently transferred to ICE custody at the Delaney Hall Detention Facility in Newark, New Jersey where he remains detained. Following his detention, Petitioner alleges he sought an expedited bond hearing pursuant to Section 236 of the Immigration and Nationality Act, and that the Immigration Court scheduled a bond hearing for July 27, 2026, at 9:00 a.m. Petitioner alleges, however, that DHS-ICE advised him that he would be transferred to another detention facility outside this District before the hearing could occur, and argues that the anticipated transfer would impair his ability to participate meaningfully in his bond hearing, consult with counsel, and preserve this Court's jurisdiction over his immediate custodian. Petitioner contends that his civil immigration detention is arbitrary, irrational, and unsupported by individualized findings in violation of the Due Process Clause of the Fifth Amendment. (Id.) Accordingly, it is ORDERED that Petitioner's Motion for Order to Show Cause (ECF No. 2.) is GRANTED. Respondents shall SHOW CAUSE, on or before August 3, 2026, why the Petition should not be granted. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of the Petition and this Order upon Respondents within two (2) business days of the entry of this Order and shall promptly file proof of service on the docket.
