TEXT ORDER : This matter is before the Court on the Petitioner's petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2241, (D.E. No. 1 ("Petition" or "Pet.")), and Respondents' July 25, 2026 letter, (D.E. No. 4 ("July 25, 2026 Letter" ).) Petitioner, a native and citizen of Burkina Faso, alleges that he entered the United States on or about April 28, 2023, at or near San Ysirdro, California, without having been admitted or paroled, was apprehended on or about May 1, 2023 and served with a Notice to Appear, and, on or about May 1 (or 2), 2023, was released on his own recognizance pursuant to 8 U.S.C. § 1226. (Pet. Paras. 25-29). Following his release, Petitioner has resided in Newark, New Jersey, has been an imam and member of the Burkina Assembly of Burkinabe, has a U.S. citizen cousin and a U.S. citizen fianc, and owns and operates a shipping business. (Id. Para. 30.) The Petition is silent regarding whether Petitioner has any criminal history. On or about July 18, 2026, U.S. Immigration and Customs Enforcement ("ICE") arrested Petitioner in a traffic stop while he was driving to work in the vicinity of Secaucus, and, according to the Petition, he has been detained at the Delaney Hall Detention Facility in Newark, New Jersey. (Id. Paras. 32-33). However, according to the July 25, 2026 Letter, "ICE has advised that Petitioner is in the process of being transferred to the El Paso Processing Center, and Petitioner's flight from New Jersey departed Newark International Airport at 4:42 p.m. on July 25, 2026." (July 25, 2026 Letter at 1 (further noting that Chief Judge Bumb's Text Order enjoining Respondents from transferring Petitioner from New Jersey pending further Order of the Court was entered at 5:52 p.m., and "[t]his Office provided notice of the Text Order to ICE at 6:05 p.m.").) "Accordingly, Respondents respectfully submit that Petitioner was transferred before the Text Order was issued and before ICE received notice of the same" and indicate that ICE is prepared to comply with any further order of the Court, including undertaking appropriate steps should the Court order his return to New Jersey. (Id. at 1). Within forty-eight (48) hours of the issuance of this Text Order, Petitioner shall: (i) assert under oath whether he has any criminal history; and (ii) respond to Respondents' July 25, 2026 Letter. The Court will take appropriate further action upon receipt of Petitioner's certification/response. The Clerk of Court shall forward a copy of the Petition, (D.E. No. 1 ), the attachments to the Petition, (D.E. Nos. 1 -1 through 1 -7), and this Text Order to the Chief, Civil Division, United States Attorney's Office, at the following email address: USANJ-HabeasCases@usdoj.gov.
