ORDER GRANTING PETITIONER JOSE MENDEZ RODRIGUEZ'S PETITION FOR WRIT OF HABEAS CORPUS. (1) Petitioner's Petition (Dkt. 1 ) is GRANTED IN PART;(2) Respondents SHALL release Petitioner Jose Mendez Rodriguez from custody within 24 HOU RS of this Order under conditions consistent with those in place at the time of his re-detention, unless Respondents choose to impose less restrictive conditions;(3) Respondents and all their officers, agents, employees, attorneys, and persons ac ting on their behalf or in concert with them SHALL NOT re-detain Petitioner unless an Immigration Court hearing is held (on adequate notice) to determine whether detention is appropriate, or until Petitioner is issued a final order of removal; and (4) Upon release, Respondents MUST return to Petitioner any personal property, including personal identification documents (other than a passport) and employment authorization documents; and(5) Respondents SHALL file a certification within 48 HOURS of the issuance of this Order, confirming that the Petitioner has been released from custody and providing the date and time of his release.Signed by Magistrate Judge Grady J Leupold.
