Service and Appointment Order It is therefore ordered that the Federal Public Defender for the District of Nevada (FPD) is appointed to represent the petitioner and is directed to file a notice of appearance (or indicate its inability to represent the petitioner) by August 5, 2026. If the FPD is unable to represent the petitioner, alternate counsel will be appointed. Appointed counsel will represent the petitioner in all federal proceedings related to this matter, including any appeals or certiorari proceedings, unless allowed to withdraw. MINUTE ORDER IN CHAMBERS of the Honorable Judge Cristina D. Silva on 8/18/2026. Petitioner Agustin Lagarreta-Acosta filed an emergency motion for expedited briefing and consideration of his amended petition and motion for temporary restraining order before August 28, 2026. ECF No. 7 . Therein, the petitioner argues that expedited briefing and consideration is warranted because he has primary custody of his four-year-old daughter and a USCIS interview scheduled for September 3, 2025, which he cannot attend if detained. Id. I find that these circumstances warrant expedited briefing and consideration, so the emergency motion [ECF No. 7] is GRANTED. The respondents are ordered to file a response to the petition and motion for TRO by August 21, 2026; any reply is due August 24, 2026.
