TEXT ORDER - Before the Court is Petitioner German Danilo Jimenez Jimenez's ("Petitioner") Petition for Writ of Habeas Corpus ("Petition") challenging his ongoing detention (ECF No. 1 ), and Motion for Temporary Restraining Order ("TRO") seeking Petitioner's release based on medical allegations (ECF No. 8 ). Respondents filed a letter response submitting the Petitioner is lawfully detained under 8 U.S.C. § 1226(a). (ECF No. 5 .) Petitioner replied arguing that Respondents failed to address Petitioner's claim that his detention is unlawful based on his warrantless arrest and that Petitioner's bond hearing was fundamentally unfair. (ECF No. 7 .) The Court finds supplemental briefing necessary. The Court notes that it lacks jurisdiction to review any discretionary determinations underlying the immigration judge's bond decision, but it can review whether the bond hearing was fundamentally unfair. Ghanem v. Warden Essex Cnty. Corr. Facility, No. 21-1908, 2022 WL 574624, at *2 (3d Cir. Feb. 25, 2022). Accordingly, it is ORDERED within five (5) days of the entry of this Text Order, Respondents shall address Petitioner's claim regarding his warrantless arrest. It is further ORDERED that Respondents shall address if Petitioner's subsequent bond hearing moots Petitioner's claim regarding his warrantless arrest. It is further ORDERED that Respondents shall address Petitioner's argument regarding his bond hearing, along with a copy of the bond hearing transcript. Finally, it is ORDERED that Respondents shall specifically address Petitioner's claims regarding his medical condition; Respondents shall include Petitioner's relevant medical records and address whether Petitioner's alleged gout presents an extraordinary circumstance under Hope v.
